California Possession-for-Sale & Drug Sale Charges
Possession for sale is legally different from simple possession. California Health and Safety Code § 11351 makes possessing or purchasing specified controlled substances for sale a felony. The prosecution must prove more than possession alone.
Health and Safety Code § 11352(a) addresses conduct that includes selling, furnishing, administering, giving away, importing, or transporting specified substances for sale. The statute can apply even when an allegation doesn’t involve a completed exchange of drugs for money.
Charges under these statutes require proof of specific facts:
- Knowledge of presence: The accused knew the substance was present.
- Knowledge of its nature: The accused knew it was a controlled substance.
- Usable quantity: A § 11351 charge requires an amount sufficient to be used.
- Intent to sell: A § 11351 charge requires a specific intention to sell the substance.
The charging decision may depend on the alleged conduct, substance, quantity, and surrounding circumstances. We examine how prosecutors classified the conduct rather than treating every drug allegation as interchangeable.
How Prosecutors Seek to Prove a Sales Purpose
Prosecutors frequently rely on circumstantial evidence, which is indirect evidence used to support an inference about what occurred. In a possession-for-sale case, they may argue that the circumstances indicate a sales purpose even without evidence of a completed transaction.
Evidence cited in support of that allegation may include:
- Substances divided among multiple baggies or containers.
- Cash found in small denominations.
- Digital scales or other items associated with measuring drugs.
- A quantity prosecutors claim exceeds an amount intended for personal use.
No single item automatically establishes intent, and prosecutors must still prove every element beyond a reasonable doubt. We examine the context, ownership, and reliability of the evidence.
Drug Distribution Representation in El Segundo
We review the allegations, available evidence, and charging decision to determine which issues require challenge. Representation can include plea negotiations, diversion arguments when legally available, and trial in state or federal court.
Cases arising in El Segundo may be heard at the Superior Court Airport Courthouse within the West Judicial District. The Southwest District Inglewood courthouse also has criminal court jurisdiction over cases arising in El Segundo and Inglewood. The assigned courthouse depends on the charge and the circumstances of the individual case.
Depending on the charge and eligibility requirements, courts may recognize alternatives to jail such as community service, drug rehabilitation centers, house arrest, work furlough, monetary fines, or suspended sentences. These alternatives aren’t automatic, and some charges restrict access to standard diversion programs. We evaluate which arguments are legally available based on the filing and record.

"Mr. Rollins is an excellent attorney."
I was arrested on a fake charge for selling drugs. Kendric was able to convince the DA that the cops entrapped me! The cops lied and were wrong and Kendric was able to prove it. In fact, the deal he worked out for me was so sweet that the judge initially didn't want to accept it! Mr. Rollins is an excellent attorney and he was kind enough to work with me on the payment.- Chris
